Gloss to the judgment of the Court of Appeal in Warsaw on October 28, 2011
Gloss concerns a judgment, which is another opinion on the charging so called self-fees fees, i.e. charging payments other than the margin for taking goods to disposal typed in article. 15 paragraph. 1 point 4 ASUC, as an act of unfair competition.
However, it is a new opinion, departing from the broad interpretation of this regulation, which has led to the fact that any fees charged by the stores from suppliers, outside of payment for the goods, were banned.
